This website and the FastFast Deliveries digital application are owned and operated by Thutha Logistics (Pty) Ltd, an enterprise duly registered in terms of the Companies Act of the Republic of South Africa under Enterprise Registration Number K2026612680 (hereinafter referred to as "FastFast", "Thutha Logistics", "we", "us", or "our").
1. Acceptance of Terms
By accessing or using the FastFast Deliveries website, mobile applications, or on-demand dispatch systems (collectively, the "Platform"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must immediately cease accessing and using our Platform.
2. Nature of the Platform & Intermediary Role
FastFast Deliveries operates as an on-demand technology platform connecting consignors (individuals, building contractors, retailers, and merchants) with independent third-party transport operators ("Drivers" or "Transporters").
Unless explicitly agreed in a bespoke commercial service level agreement, Thutha Logistics acts as an intermediary technology provider facilitating dispatch, matching, telematics, and payment settlement.
3. User & Consignor Responsibilities
- Accurate Cargo Disclosure: Senders must accurately state cargo dimensions, estimated weight, fragile nature, and specific handling requirements (e.g. palletized cement, timber length).
- Packaging & Staging: Senders are responsible for properly securing and packaging goods prior to driver arrival at the pickup point.
- Recipient Availability: The sender must ensure the consignee/recipient is available at the destination to inspect and accept the cargo and provide the secure OTP verification PIN.
4. Prohibited & Hazardous Goods
The platform strictly prohibits the booking, loading, or transport of the following items:
- Hazardous class 1 explosives, unauthorized volatile chemicals, and unpermitted radioactive substances;
- Illegal narcotics, stolen property, unmanifested contraband, or counterfeit merchandise;
- Human passengers (the platform is strictly engineered for goods and freight);
- Untagged live animals or livestock unless booked via specialized agricultural permit;
- Cargo exceeding the legally rated gross vehicle mass (GVM) of the assigned transport vehicle.
5. Driver Compliance & Standards
In compliance with the South African National Road Traffic Act (Act 93 of 1996), all active drivers on the FastFast platform must maintain:
- A valid Driver's License accompanied by an unexpired Professional Driving Permit (PrDP);
- A valid, current Vehicle License Disc displayed on the vehicle windscreen;
- Roadworthy vehicles equipped with functional cargo tie-downs and weather protection;
- Adherence to all municipal traffic bylaws and national road safety regulations.
6. Pricing, Payments & Invoicing
All delivery rates are quoted in South African Rand (ZAR) inclusive of applicable taxes. Payments are securely processed via tokenized South African payment gateways or approved 30-day merchant accounts. Drivers are compensated according to established distance and payload schedules after platform technology fees.
7. Goods in Transit, Liability & Insurance
While FastFast strictly vets drivers and monitors deliveries in real-time via GPS telematics, senders with high-value commercial merchandise are advised to opt for supplemental Goods in Transit (GIT) insurance coverage where available during booking. FastFast's liability as a technology intermediary is limited to the extent permitted by the Consumer Protection Act (CPA) of South Africa.
8. Cancellations & No-Show Fees
If a sender cancels a booking after a driver has been dispatched and traveled towards the pickup location, a standard dispatch cancellation fee may apply to compensate the driver for fuel and time. Similarly, drivers who fail to fulfill accepted dispatches without emergency justification face suspension.
9. Applicable Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising in connection with the Platform shall be subject to the exclusive jurisdiction of the competent courts within South Africa (specifically the Eastern Cape Division).
